Privacy and Data Protection Notice

Data protection is of utmost importance to DAIGE Kft., therefore we will process personal data in accordance with the applicable legislation and security regulations.

1.1 This Privacy and Data Protection Notice (hereinafter referred to as the "Notice") contains the main data protection rules and principles applicable to the records kept by DAIGE Kft (hereinafter referred to as the Owner). The purpose of the Notice is to set out the data protection and data management principles and rules and the conditions and methods of data processing applied by the Owner in accordance with the provisions of the applicable Hungarian and Union legislation and in the interests of the data subjects.
1.2. The Owner operates the webshop available at https://daige.pro (hereinafter: the Website), where the products produced or distributed by the Owner can be purchased (the visitors and buyers hereinafter jointly: Users).
1.3, and Regulation (EU) 2016/679/EU of the European Parliament and of the Council on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter referred to as GDPR).
1.4 The Owner reserves the right to inform the User by e-mail of any changes to the services it provides or to its general terms and conditions. The Owner shall not use the information for advertising purposes.

- DATA PROCESSING BY THE OWNER
3.1 Registration
After registration, the User is entitled to use the services provided on the Website. During registration, the User's personal data are recorded which are necessary for the identification of the products ordered online for mailing or personal delivery.
Prior to registration, the User gives his/her consent to the processing of the data by using a "checkbox", as a prerequisite for which the User declares his/her acceptance of the processing of the data and his/her acceptance of the General Terms and Conditions, which include the Data Protection Notice of the Data Controller. The processing of the data by the Owner is based on the User's consent. The process of registration and other uploading options is governed by Clause III of the GTC. Registration is not required to make a purchase on the Site.
Purpose of processing: identification of the User on the website
Legal basis for processing: necessary for the User's order, sending the newsletter and for the performance of activities to which he/she has subscribed.
Duration of processing: the User has the right to delete his/her data from the Owner's records free of charge at any time or to request the Owner to delete his/her data, which request the Owner shall comply with free of charge within 30 days.

Legal basis for processing: the User's voluntary, explicit consent (Article 6(1)(a) GDPR and Section 6 of Act XLVIII of 2008 on the basic conditions of commercial advertising). Consent may be withdrawn at any time, without giving reasons and free of charge, using the unsubscribe link at the bottom of every newsletter, or by writing to contact@daige.pro. The withdrawal does not affect the lawfulness of processing carried out before the withdrawal

Method of data storage: the Owner shall store the User's registered data on the hosting provider operated by the newsletter service provider (hereinafter ActiveCampaign).
The User is entitled to use the service after registration, the procedure is regulated in point IV of the GTC.

Personal data registered by the User are not controlled by the Owner. The User is solely responsible for the correctness of the data registered. The User shall be responsible for the availability and use of the data transmitted by the Owner to the e-mail address registered by the User.
4.1. Data processing by the payment service providers
Card payments on the Website are processed by Shopify Payments, and PayPal payments by PayPal (Europe) S.à r.l. et Cie, S.C.A. These providers process the User's personal data as independent controllers in order to execute the payment. The Owner does not receive, see or store the User's bank card details.

- Processing of registered data
The data registered by the User may be accessed by the Owner and the person(s) designated to process the data. The access rights to the Owner's data processing process shall be determined by the Owner's chief executive officer. The Owner is entitled and obliged to transfer data to a third party for the purposes of its legal obligations (bank payment service provider and service provider responsible for delivery).

6.1 The User can delete his/her profile by deleting himself/herself from the system, but his/her orders will remain in the system without personal data.
6.2 The User has the right to request, free of charge, information on the personal data processed, the purpose, legal basis and duration of the processing, the name, address (registered office) and activities of the controller and processor, as well as the persons and means of access to the data, the rights of the data subject in relation to the processing and the remedies available to him/her. The User has the right to request, free of charge and in cases provided for by law, the rectification, erasure, blocking or restriction of processing of his/her data and to object to the processing of his/her personal data.
6.3 The Owner is obliged to examine the User's request within the shortest possible period of time from the submission of the request, but not later than 30 days, or 15 days in case of objection, and to decide on the merits of the request, which shall be sentto the User in writing. If the Owner does not comply with the User's request, it shall inform the User of the factual and legal grounds for refusing the request in its decision.
6.4 The User shall be entitled to enforce his/her rights before the courts pursuant to Act V of 2013 on the Civil Code, and to lodge a complaint with the National Authority for Data Protection and Freedom of Information (1055 Budapest, Falk Miksa utca 9-11.; postal address: 1363 Budapest, Pf. 9.; https://www.naih.hu) pursuant to the Infotv.

8.
8.1 The Owner collects data on the activity of interested parties in a way that does not identify the interested parties, cannot be linked to the personal data provided by the User during registration or to the data provided when using other websites or services.
8.2 The Owner is obliged to inform the User in advance and to obtain his/her prior explicit consent if the User intends to use his/her personal data for a purpose other than the purpose for which he/she has provided the data.
8.3 The Owner shall ensure the security of data processing and shall take all necessary technical measures to protect the data recorded, stored and processed and to prevent their unauthorized use,modification or destruction.
8.4 The Owner shall keep records of its data processing activities as required by law (records of processing activities).
8.5 A data breach is a breach of security that results in the accidental or unlawful destruction, loss, alteration, unauthorized disclosure of or access to the personal data processed. In the event of a data breach, the Owner shall act in accordance with Articles 33 and 34 of the GDPR. The Owner shall keep a record of the data breach, indicating the facts relating to the data breach, its effects and the measures taken to remedy it.
8.6 The Owner may unilaterally amend this Policy at any time. The Owner shall publish any amendment to this Notice on its website. The User shall be entitled to continue to use the services of the Website after acceptance of the amendment to this Notice.
8.7 Payments made on the Website are executed by Shopify Payments and PayPal (Europe) S.à r.l. et Cie, S.C.A. Bank card data are entered directly into the payment provider's secure interface; DAIGE Kft. does not receive, process or store bank card numbers, expiry dates or security codes.
